These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by participating, all entrants will be deemed to have accepted and be bound by the terms and conditions. General Competition Terms
Eligibility:
This promotion is open to all customers aged 18 or over globally excluding employees and the immediate families of the Hardtuned Pty Ltd, its subsidiaries, other group companies, its agents, or anyone else professionally connected with this promotion.
Promotion Period:
The competition begins at 5:00pm AEST on Thursday, August 14, 2025, and closes at 12:00pm AEST on Sunday, August 31st, 2025. All purchases made on the Hardtuned website during this period are eligible for entry. Entries submitted outside of the promotional period will not be eligible for the competition.
Entry Method:
One entry is accumulated per purchase made through the Hardtuned website.
Draw Date:
The winner will be randomly selected on September 10, 2025, at 1pm AEST. Hardtuned will contact the winner via phone or email. If the winner cannot be reached within 14 days of the draw date Hardtuned reserves the right to select another winner. Hardtuned reserves the right to modify the draw date in the event of unforeseen circumstances or technical issues that prevent the competition from concluding as planned. In such cases, entrants will be notified of any new draw date, and all valid entries received will be included in the rescheduled draw.
Specific Prize Terms and Conditions:
The prize for this promotion is one (1) Apple iPhone 16 Pro Max 256GB only. No other models, colors, storage capacities, or alternative products will be provided.
Alternative Prize:
If the winner does not wish to claim this prize, Hardtuned will provide an alternative cash prize of $1,000 USD in lieu of the original prize package. The substitution prize is final, non-transferable, and no further compensation will be provided.
Data Collection and Privacy:
By entering this competition, participants agree to the collection and use of their personal information by Hardtuned Pty Ltd solely for the purpose of administering the competition, fulfilling prizes, and for any other purpose directly related to the competition. Hardtuned will handle all personal data in accordance with its privacy policy and applicable data protection laws. Participants’ information will not be shared with third parties, except as necessary for prize fulfilment or as required by law. Entrants have the right to access, update, or request the deletion of their data at any time by contacting Hardtuned at sales@hardtunedstore.com.
Release and Limitations of Liability:
By participating in this competition, entrants agree to release and hold harmless Hardtuned, its affiliates, partners, employees, agents, and any associated entities (collectively, the “Released Parties”) from any claim or cause of action arising out of participation in the competition or receipt or use of any prize, including but not limited to: (i) any technical errors or interruptions that may prevent an entrant from submitting an entry; (ii) unauthorised human or technical intervention in the competition; (iii) errors in the administration, processing, or handling of entries; (iv) printing or typographical errors; (v) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the entrant’s participation in the competition or acceptance, receipt, or use/misuse of any prize; or (vi) any delays, changes, or cancellations in the availability of prize components.
Furthermore, Hardtuned shall not be liable for any costs beyond those specifically outlined in the prize components listed above, nor for any additional expenses, incidental costs, or changes that may arise due to delays or adjustments in prize availability. Entrants agree that, in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the competition, and in no event shall the Released Parties be liable for legal fees. Entrants waive the right to claim any damages, including but not limited to punitive, consequential, direct, or indirect damages.
In case of force majeure events beyond the reasonable control of Hardtuned, including but not limited to natural disasters, war, civil unrest, or any public health crisis, Hardtuned reserves the right to cancel, terminate, modify, or suspend the competition or any component of the prize without liability.
